The Tenant Rights

Signing a contract rental agreement comes with responsibilities. It is prudent to understand the legal aspects of being a tenant in Mauritius.

Once you’ve carried out viewings and selected the property you would like to rent, you’ll need to go through your tenancy agreement. The signing of this rental lease agreement certifies the rights and obligations of both parties, namely the Lessee and the Landlord.

Firstly, the tenant is entitled to a home in good condition of use. This includes the dwelling itself and its contents, such as cupboards, appliances, and furniture, among others. The landlord is therefore obliged to provide a well-maintained property to his tenant.

Furthermore, the agreement must specify the lease period, including the date at which the property will become available. The agreement must state the property by listing all the rooms and an inventory of the furniture and equipment, the amount of the monthly rent, the security deposit, the conditions for revising the rent, and the terms of termination of the lease.

Note - The owner has no right to enter the premises without authorization and without giving notice to the tenant; this should be included in the contract agreement. Inspection visits should also be scheduled ahead of time with notice to the tenant.


What are my obligations as a tenant?

It goes without saying that you must pay the rent and charges per the dates specified in the lease contract agreement. The rented house must be used for the purpose agreed upon. The maintenance of the rental home is also the tenant’s responsibility, i.e., minor repairs like plumbing, electrical.


What can I or can’t I do?

On a rental basis, you are not permitted to transform the premise without the landlord’s approval. In the absence of this agreement, the landlord can evict the tenant for breaching this term.
